COMPLAINT POLICY AND TERMS

1. INTRODUCTORY PROVISIONS

 

1.1 This Complaints Procedure (hereinafter referred to as the "Procedure") is issued in accordance with Act No. 89/2012 Coll., the Civil Code, as amended, and Act No. 634/1992 Coll., on Consumer Protection, as amended.

 

1.2 These Rules regulate the manner and conditions of complaints for services provided by the operator SoloGym (hereinafter referred to as the "Operator").

 

2. RIGHTS FROM DEFECTIVE PERFORMANCE

 

2.1 The Operator is responsible for the fact that the services provided by SoloGym are in accordance with the concluded contract.

 

2.2 The rights and obligations of the contracting parties with regard to rights of defective performance are governed by the applicable generally binding legal regulations.

 

2.3 The purchaser is entitled to exercise the right of defect that occurs in the service provided within 24 months of the provision of the service.

 

3. CLAIMS PROCEDURE

 

3.1 Complaints can be made in writing to the address of the operator or electronically to the e-mail address: sologym247@gmail.com.

 

3.2 The complaint must include:

 

the name and surname of the purchaser,

contact details (telephone, e-mail),

description of the defect,

the date and time of the service.

 

3.3 The Operator undertakes to settle the complaint within 10 days from the date of its submission, unless a longer period is agreed with the Buyer.

 

4. DEFECT REPAIR

 

4.1 If the complaint is justified, the operator shall, according to the nature of the defect:

 

provide a replacement or additional service,

offer a reasonable discount on the price of the service,

refund the money for the service provided.

 

4.2 The Buyer will be informed of the method of handling the complaint by e-mail or telephone specified in the complaint.

 

5. PROTECTION OF PERSONAL DATA

 

5.1 When processing complaints, customers' personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).

 

5.2 Customers' personal data is only processed to the extent necessary for the settlement of the complaint and is not passed on to third parties, except where necessary for the settlement of the complaint.

 

6. FINAL PROVISIONS

 

6.1 This Complaints Procedure forms an integral part of the SoloGym Operator's Terms and Conditions and is published on the website www.sologym.cz.

 

6.2 The Operator reserves the right to amend these Rules at any time. Amendments to the Complaints Procedure are effective on the date of their publication on the website.
